2.1 The Web 4 Less is a membership site offering Tips & tricks and other content relating to effective website promotion, planning, creating, and marketing (the “Service”), included within these services are the supply of domain name, cloud hosting, back-up, support, web design using WordPress CMS and the DIVI template, and additional premium plugins.

2.2 Use of theweb4less.co.uk, including all materials presented herein and all online services provided by The Web 4 Less, is subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, customers, and all other users of the site. By using the Site or Service, you agree to these Terms and Conditions, without modification, and acknowledge reading them.

2.3 Parties agree that the Service is in the nature of education. The scope of services provided by The Web 4 Less according to this Agreement are limited to those listed on theweb4less.co.uk website. We reserve the right to substitute services equal to or comparable to the services listed if the need arises, without prior notice.

3.USE OF THE SITE AND SERVICE

3.1 To access or use the Site, you must be 18 years of age or older and have the requisite power and authority to enter into these Terms and Conditions. Children under the age of 18 are prohibited from using the Site. Information provided on the Site and in the provision of the Service and other information are subject to change. We make no representation or warranty that the information provided, regardless of its source (the “Content”), is accurate, complete, reliable, current, or error-free. The Web 4 Less disclaims all liability for any inaccuracy, error, or incompleteness in the Content.

3.2 Our website is only intended for use by adults, as defined as those aged 18 or over and who have sufficient capacity to enter into a binding agreement.

4.ACCOUNT CREATION

4.1 As part of the registration process you will need to create an account, including a username & password. It is your responsibility to ensure that the information you provide is accurate and not misleading. You cannot create an account or username & password using the names and information of another person or using words that are the trademarks or the property of another party or vulgar, obscene or in any other way inappropriate.

4.2 You are responsible for maintaining your own username and password via our website. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party.

4.3 You are responsible for your customer account and any actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.

  17. cause inconvenience or needless anxiety to any person.

6.PRODUCTS & PRICING

6.1 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product or service is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable).

6.2 We reserve the right to alter all product and service pricing without notice.

7.YOUR ORDER

7.1 When you place an order you will automatically receive a confirmation email from us to confirm your order. Your order constitutes an offer made to us to purchase a membership program.

7.2 Your offer is only accepted by us once we have emailed you to confirm the creation of your account and your username & password details.

7.3 Product or service items not included within your account are not included in the order and contract between you and us.

7.4 We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.

7.5 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third-party card or account.

8.REFUSAL OF SERVICE

8.1 The Services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. We may at any time change or discontinue any aspect or feature of the Site or Service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.

9.DURATION OF AGREEMENT

9.1 Once confirmed, we will provide you access to the purchased membership package. You agree and understand that access to your membership may at times be influenced and affected by third parties that we use to provide the Service (web hosting, membership site plugins, etc.). You agree and understand that no breach of contract action may be initiated against The Web 4 Less when there are reasonable delays in the access of the Service.

9.2 We reserve the right to terminate your membership, and or access to certain features of the package, with or without prior notice to you. We will make reasonable efforts to provide notice but is not required to do so under the terms of this agreement.

9.3 If for any reason, The Web 4 Less should dissolve or cease to exist, then your access to the Service terminates.

10.CANCELLATIONS & REFUNDS

10.1 You may cancel your monthly subscription at any time via your account, or by direct contact with your membership coordinator through email, but due to the nature of the Service no refunds will be made for any membership fees already paid.

10.2 Once you cancel you will no longer have access to the membership, including all content, domain, hosting, website and community resources, once your current membership period is completed.

10.3 Should you wish to retain your website and move to a new host, there is a singular, payment of £100. Once this has been made you will be provided with a complete back up of the website, including content and media, and the EPP code, or similar to release the domain to your new host. Please bear in mind, you will need to recreate all emails, and The Web 4 Less are not responsible for installation of the back up, or any data loss.

10.4 It is entirely your responsibility to ensure that you cancel your account in good time should you no longer require the membership and do not wish to be billed further.

11.UPGRADING

11.1 There are additional add-ons available through theweb4less.co.uk website which allow you additional access to functionality and content for your membership. You can upgrade and downgrade at any time simply by signing up for the add-on package of your choice and paying the fee.

11.2 Please be aware that these add-ons represent an increase in your monthly membership package for the duration of your subscription. They are not unless otherwise indicated a one-off payment.

12.MEMBERSHIP DESCRIPTION

12.1 We endeavour to describe and display the membership options as accurately as possible. While we try to be as clear as possible in explaining the memberships, please do not accept that the Site is entirely accurate, current, or error-free. From time to time we may correct errors in pricing and descriptions. We reserve the right to refuse or cancel any order with an incorrect price listing.

13.MATERIAL YOU SUBMIT TO THE SITE

13.1 You shall not upload, post or otherwise make available on the Site any artwork, photos, or other materials (collectively “Materials”) protected by copyright, trademark, or other proprietary right without the express written permission of the owner of the copyright, trademark, or other proprietary right, and the burden of determining that any Materials are not so protected rests entirely with you.

13.3 As a benefit of your membership, we sometimes provide access to a community or social media platform.  The Web 4 Less is not required to provide a community platform, and has complete discretion with regards to the platform, and the nature of the interaction, dependent on the membership package.

13.4 You agree that usage of these platforms is a privilege. We reserve the right to limit or deny access to these platforms for misconduct that includes but is not limited to being inappropriate, rude, violent, or threatening. The Web 4 Less will make reasonable efforts to provide notice to you with regards to inappropriate or unapproved content that you have placed. We are not required to provide notice, and reserve all rights to take immediate and appropriate action to protect the brand and image integrity.

14.INTELLECTUAL PROPERTY RIGHTS TO YOUR MATERIALS

14.1 We claim no intellectual property rights over the material you supply. You retain copyright and any other rights you may rightfully hold in any content that you submit through the Site or Service. Content you submit to us remains yours to the extent that you have any legal claims therein. You agree to hold The Web 4 Less harmless from and against all claims, liabilities, and expenses arising out of any potential or actual copyright or trademark misappropriation or infringement claimed against you. The Web 4 Less copyrighted and original materials are provided to you as part of the Service for your individual use only and a single-user license. All intellectual property, including our copyrighted materials shall remain the sole property of The Web 4 Less. No license to sell or distribute our materials is granted or implied.

15.2 You may not in any way exploit in any format whatsoever any of the Site, Content or intellectual property, in whole or in part, without our prior written consent. This includes but is not limited to sharing material with others, posting excerpts of material on any social media, blogging about the material, or in any other way that would reasonably appear to share the Site or Service’s information with a non-member.

15.3 We reserve the right to immediately revoke your membership access, without refund, if you are caught violating this intellectual property policy.

16.1 We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us posting the new Terms and Conditions on our Site. Any use of the Site or Service by you after being notified means you accept these amendments.

17.LIMITATION OF LIABILITY

  • In no event shall our cumulative liability to you exceed the total purchase price of the service you have purchased from us, and if no purchase has been made by you our cumulative liability to you shall not exceed £100.

You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, or policies of third-party websites or resources. 19.INDEMNIFICATION

20.2 No waiver of any of the provisions of this Agreement by The Web 4 Less shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver.

22.RECOVERY OF LITIGATION EXPENSES

22.1 If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

23.SEVERABILITY

23.1 If any term, provision, covenant, or condition of this Agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
